A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without legal authority.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.

The situation stems from a erroneous removal to El Salvador in March, which US authorities later acknowledged was an error. After his repatriation to the United States to answer human smuggling allegations, he was detained in federal detention.

In her decision, the court pointed out that the government lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
