Michael Jordan Testifies He Felt No Fear of the Racing Body in Legal Battle
Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, stated that his drive to win and status as a newcomer emboldened his push for 23XI Racing to “challenge” Nascar over perceived violations of antitrust rules.
Team Investment and a Will to Win
Jordan shared financial and corporate details of his 23XI team, saying he invested $40 million of his personal wealth into the Nascar Cup series team launched with business partner Curtis Polk and driver Hamlin.
“Someone had to step forward,” Jordan said during testimony. “As a newcomer, I had no fear. I believed I could take on Nascar as a whole. I felt as far as the sport it needed to be looked at from a different view.”
The Core Dispute: Charter Agreements and Contract Pressure
The heart of the case involves the end of a 2016 deal where Nascar provided each team a franchise. This system mirrors other major leagues with independent franchises, such as the NBA’s Hornets or the NFL’s Panthers. This deal was set to expire in 2024 when Nascar insisted on teams renew their charters.
Jordan was on the witness stand for about sixty minutes and exited the courthouse to pandemonium, with onlookers and reporters vying for a view or a picture of the global icon.
Spearheading the Fight
23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a business model Jordan said is breaking the law to keep two hands on the wheel.
At issue for Jordan and Heather Gibbs, who testified before Jordan, are details from last September. Gibbs described a hectic and tense six hours where the sanctioning body told teams they must sign a charter agreement extension. The document spanned over a hundred pages outlining team compensation and a guaranteed spot in Nascar-sponsored races.
Choosing Litigation
Jordan explained that 23XI and Front Row Motorsports concluded their sole viable path was to refuse a signature that extensive document and take the issue to court. All other teams agreed to the terms.
The team owners reached out to Nascar about possible changes or extension options. Nascar wasn’t talking, Jordan said.
The Bottom Line: Victory
But in the end, the resistance against what he saw as a financially unsustainable model was driven by the familiar goal for Jordan: Success.
“Denny convinced me adding a third car boosted our odds of winning,” he said, sharing that he bought a third charter last year for $28 million amid the legal dispute. “So I took the plunge.”
Account from the Gibbs Family
Gibbs described her request for permanent charters, which she said a formal letter to Nascar. She testified the timing of the contract signing demand was problematic.
According to her, the team founder first tried to call and talk Nascar out of forcing signatures, but CEO Jim France declined the request.
“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s executives. She said France replied, “Whether I have 20 charters, that’s what I have. If there are 30, I have 30.”
